These Terms of Service ("Terms") govern your access to and use of Inkswell's website, app, and related services ("Services"). By using our Services, you agree to these Terms and our Privacy Policy (collectively, the "Agreement"). If you do not agree, do not use the Services.
You must be at least 13 years old (or older if required in your jurisdiction) to use Inkswell. By using the Services, you represent that you meet this requirement and have the authority to agree to these Terms.
You may use Inkswell to generate artwork and images using our AI model, and to purchase physical prints of your generated artwork.

You must create an account to use certain features. You are responsible for maintaining the confidentiality of your credentials, all activity under your account, and notifying us immediately if you suspect unauthorized access. Inkswell is not responsible for losses due to compromised credentials.

a. User-Generated Content
You own the rights to prompts you input and images and artwork generated through your use of the Service (to the extent permitted by law). By using the Service, you grant Inkswell a non-exclusive, worldwide, royalty-free license to host, display, and use your generated content solely for providing and improving the Services; internal research, moderation, and training; and marketing or showcasing Inkswell (with your consent where required).
b. Company Property
All code, models, data, text, graphics, and trademarks on Inkswell's platform are owned by Inkswell, LLC or its licensors. You may not copy, distribute, or modify them without written permission.
You may use the artwork you generate for personal or commercial purposes, provided you comply with these Terms and applicable laws. You are solely responsible for ensuring your use does not infringe third-party rights.
You may not use Inkswell to generate or share content that contains nudity, sexual, or pornographic material; depicts violence, discrimination, or illegal activity; infringes intellectual property or privacy rights; includes false or misleading claims; or harasses or defames others. We may suspend or delete accounts that violate these rules.
We may modify, suspend, or discontinue any part of the Services at any time without notice. We are not liable for interruptions or data loss resulting from such changes.
The Services are provided "as is" and "as available." Inkswell makes no warranties of any kind, express or implied, regarding the reliability, accuracy, or suitability of generated outputs or prints. You understand that AI-generated content may produce unpredictable or unintended results.
To the maximum extent permitted by law, Inkswell and its affiliates shall not be liable for any indirect, incidental, or consequential damages; loss of profits, data, or business opportunities; or any content generated by the user or the AI system. Total liability for any claim shall not exceed the amount you paid to Inkswell in the past 12 months.
You agree to indemnify and hold harmless Inkswell, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law principles. Any dispute will be resolved in the state or federal courts located in New Jersey, and you consent to their jurisdiction.
You may stop using the Services at any time. We may suspend or terminate your account if you breach these Terms or use the Services in a harmful or unlawful way. Upon termination, your right to access the Services ceases immediately.
We may update these Terms periodically. The new version will be effective when posted. Your continued use constitutes acceptance of any changes.
